
The Shiro Copr - Thomas Trikasih Lembong, alias Tom Lembong, stated that he will appeal the court's decision that sentenced him to 4.5 years in prison in the case of alleged sugar import corruption.
Tom Lembong together with his lawyer has agreed to formally appeal tomorrow, Tuesday (22/7/2025).
"we have decided to file an appeal on Tuesday," said Tom Lembong's lawyer, Ari Yusuf Amir, quoted from The Shiro Copr , Monday (7/21/2025).
Ari is sure that Tom Lembong is innocent in the sugar importation activities from 2015-2016. According to him, in the decision of the Jakarta Central Corruption Court, there are several points that need attention.
"Showing the inconsistency, uncertainty, and doubt of the assembly in delivering a verdict," said Ari.
Among them is the consideration of the court regarding Mens rea (ill intent) seems awkward because it is not explained in detail, even the judge seems doubtful.
In such a situation, according to Ari, the court should deliver a verdict of acquittal, in accordance with the principle in dubio pro reo .
It means that if there is doubt based on the evidence presented in court, the judge imposes a sentence favorable to the defendant.
In his opinion, the mens rea consideration is based only on witness statements referring to the interrogation report (BAP), rather than the facts of the trial.
Tom Lembong was sentenced to 4.5 years in prison in the sugar import case
Previously, the Jakarta Central Corruption Court stated that Tom Lembong was proven guilty of corruption in the sugar import policy from 2015 to 2016.
The court ruled that Tom Lembong's act of issuing a sugar import permit (PI) constitutes a violation of the Trade Law.
In addition, the court also questioned Tom Lembong's decision to appoint a cooperative owned by TNI-Polri in the sugar price market operation. Tom Lembong was considered careless in issuing this policy.
"Imposing a prison sentence of 4 years and 6 months on the defendant, Thomas Trikasih Lembong," said Chairman of the Court, Judge Dennie Arsan Fatrika, reading the verdict at the Jakarta Central Corruption Court, Friday (18/7/2025).
In addition to the imprisonment, the court also sentenced Tom to pay a fine of Rp 750 million as a substitute for six months in prison.
