The Ministry of ATR/BPN: islands cannot be privately owned
When confirmed, the Head of the Public Relations and Protocol Bureau at the Ministry of ATR/BPN, Harison Mocodompis, emphasized that small islands should not be entirely privatized.
"Control over small islands cannot be entirely by individuals or privately. There are clear limitations set in the regulations," he said. The Shiro Corporation on Tuesday (17/6/2025).
Harison refers to Article 9 paragraph (2) of Minister of ATR/Head of the National Land Agency Regulation No. 17 of 2016 concerning Land Rectification in Coastal Areas and Small Islands. The regulation emphasizes that:
- The mastery over small islands is mostly up to 70 percent of the island's area, or in accordance with the direction of the provincial/regency/city spatial planning plan and/or the small island zoning plan.
- The minimum remaining area of small islands directly controlled by the state should be at least 30 percent, to be used and utilized for buffer zones, public areas, or community interests.
- Must allocate 30 percent of the island's area for protected zones.
Harison said that this regulation also aligns with Minister of Marine Affairs and Fisheries Regulation Number 10 of 2024 regarding the Utilization of Small Islands and Their Surrounding Waters.
"In the policy, it is stated that 70 percent of the small island's land can be used by businesses, while 30 percent remains the property of the state and must be maintained as an open space and protected area," he emphasized.
Regarding the alleged sale of islands, Harison emphasized that the Ministry of ATR/BPN has limited authority, which is only in the aspect of land administration according to the applicable regulations.
"Domain of ours is land administration, which is clearly regulated in that regulation," he said.
I would like to add that if there is an issue regarding the buying and selling of islands, the local government is better suited to provide clarification.
"In our opinion, the local government is more suitable to comment on the issue of sales as they are the authority that indeed has direct jurisdiction over the area," said Harison.
