“ KAK , yesterday I just bought a new phone and suddenly it lost signal. The seller told me to go to Customs, but can I use an IMEI unlock service instead?

Why do I have to register IMEI, even though we buy the phone ourselves?

Hey, registering an IMEI must be expensive, right? How much do you have to pay to the Customs?

For those of you who have ever heard or even experienced similar problems and want to know how to register an IMEI as well as the fees involved, make sure to read this article until the end!

If you like shopping for telecommunications devices such as mobile phones (HP), handheld computers, and tablets (HKT), you probably still often encounter sellers of these devices offering choices at prices below market price, but they can only provide store warranties with a limited duration.

The community often refers to it as illegal market (BM) mobile phones. They can sell at a lower price than the market price because they enter Indonesia through illegal channels, thus avoiding taxes and also not meeting the requirements and restrictions set by the relevant Ministry.

The proliferation of illegal telecommunications devices circulating gives a bad impact on the market as it will damage competition. Legal mobile phones, whether produced/assembled domestically or imported legally and have met technical requirements and have paid taxes, must compete with illegal mobile phones that do not pay taxes.

With the widespread distribution of these illegal telecommunications devices, which is quite massive, it not only damages the market ultimately weakening the domestic telecommunications equipment industry, but also harms the state in terms of taxation and disadvantages consumers by providing products that do not guarantee quality (do not ensure compliance with technical specifications).

To reduce the number of illegal telecommunications devices, protect consumers, secure state revenue, and create a more equitable market competition, the government needs to issue regulatory policies for these telecommunications devices, specifically through the implementation of an International Mobile Equipment Identity (IMEI) control program, effective from April 18, 2020.

The international identity used to identify telecommunications devices to access the national mobile network is called the International Mobile Equipment Identity (IMEI). Regulation of the Director General of Customs and Excise Number PER-7/BC/2023, which amends the Regulation of the Director General of Customs and Excise Number PER-13/BC/2021, is one of the bases for the regulation of IMEI registration and notification for telecommunications devices in customs notification.

The IMEI policy involves several agencies (cross-agency), what is the position/role of Customs in this matter? In the IMEI control program, there are several agencies involved, namely: the Ministry of Communication and Informatics, the Ministry of Industry, the Ministry of Trade, and the Ministry of Finance (represented by Customs in this case). The role of Customs in controlling telecommunications devices is for imported telecommunications devices as well as controlling telecommunications devices in Free Zones.

One of the main functions of Customs is to protect the public, domestic industries, and national interests by monitoring and/or preventing the entry of imported goods that have negative and dangerous impacts, which are prohibited and/or restricted by regulations. Broadly speaking, the supervision carried out by Customs is conducted both administratively and physically.

Administrative oversight of HKT is carried out by issuing regulations on the mechanism of IMEI notification and registration as mentioned in PER-7/BC/2023, and creating specific conditions/treatment for HKT in the Free Zone as mentioned above. Physical oversight of illegal entry of HKT is conducted through sea patrols that are carried out routinely or based on targeted analysis from intelligence, and also taking action against the illegal entry of HKT.

What needs to register the communication device is:

a. Entrepreneurs/manufacturers, for telecommunications equipment produced or assembled domestically.

b. Importer, for telecommunications equipment imported via cargo.

c. Passengers and Crew of Transport Vehicle, for telecommunication devices purchased outside the customs area.

d. Postal Service, for telecommunications equipment imported from outside the customs area.

What is the registration process like, is it difficult?

a. Entrepreneurs/manufacturers, for telecommunications equipment produced or assembled domestically, register through the Ministry of Industry.

b. Importer, for telecommunications equipment imported via cargo, by submitting an IMEI list to be imported to the Ministry of Industry. This list is then used by the Surveyor to conduct inspections before shipment. The Surveyor's report on the IMEI inspection becomes additional customs documentation at the time of Customs Declaration (PIB), and is used for reconciliation with the Ministry of Industry regarding the implementation of imports.

c. Passengers and Transportation Crew Members, for telecommunications devices purchased outside the customs area. Passengers and transportation crew members who carry telecommunications devices purchased outside the customs area can register the IMEI by filling out the form available in the mobile customs application or through the website. www.beacukai.go.id At the time of departure or before passing Customs officers at the arrival terminal/airport.

d.    Postal Service Provider, for telecommunications equipment sent from outside the customs area to the Customs Office when submitting the consignment note document.

With the control of telecommunications devices through IMEI, only devices whose IMEIs are registered can be used for communication (not blocked). Therefore, the public who buy telecommunications devices from abroad must ensure that the IMEI has been registered upon arrival, or include it in the CN documentation if sent via shipment.

For example, Cici has just returned from Malaysia and wants to register the IMEI of her new phone purchased in Malaysia in Indonesia. First, Cici needs to fill out the form electronically through https://www.beacukai.go.id/register-imei.html Cici can also use electronic customs declaration (ECD) through https://ecd.beacukai.go.id/ Upon arrival in Indonesia, by showing supporting identity documents such as passports, boarding passes, receipts, and others. Here, Cici receives an exemption of up to USD 500. For example, if Cici brings an iPhone from abroad worth USD 400, then the iPhone registered with its IMEI at the Customs office at the Arrival Terminal is not subject to import duties.

However, if Cici has left the airport terminal, Cici can still register at the nearest Customs Office no later than 60 days from arrival. If not, Cici will not be able to obtain the import duty exemption facility.

We ensure that there is no cost for registering the IMEI of the device; the costs involved are related to the import of electronic devices such as mobile phones, tablets, and computers (HKT), which include import duties and import taxes if they do not meet the exemption criteria. The details of the charges applicable when registering the IMEI for HKT brought in by passengers are as follows:

1. Import Duty for Bea Masuk: 10 percent of the customs value.

2. Value Added Tax (VAT): 11 percent of the import value.

3. Import Value Added Tax (VAT) under Article 22 of Income Tax (PPh):

a. 10 percent of the import value for those who have a Taxpayer Identification Number (NPWP).

b. 20 percent of the import value for those who do not have NPWP.

How is it calculated? For example, if the price of the iPhone brought in is 10 million.

1. Bea Masuk 10 percent x Rp 10,000,000 = Rp 1,000,000

2. PPN 11 percent x (Rp. 10.000.000 + Rp 1.000.000) = Rp. 1.210.000

3.    PPh (if there is an NPWP) 10 percent x (Rp. 10,000,000 + Rp 1,000,000) = Rp 1,100,000

So the total collection of Import Duty and PDRI (VAT and Income Tax) = Rp. 3,310,000

Electronic devices purchased from a local store within the country cannot register for IMEI because only devices brought in from abroad or sent can be registered by Customs. Therefore, if there is an issue with the IMEI being blocked on a locally purchased device, the buyer must coordinate with the seller to resolve the issue.

To be safe, for those of you who will be purchasing telecommunications devices domestically, it's best to check the validity of the IMEI first. To check the IMEI number on your phone, you can start with the simplest method using the dial pad. Open the phone app and type *#06#. The screen will automatically display the device's IMEI number. Another alternative is to also check through the phone's settings menu. Go to 'Settings', then select 'Phone Information' or 'About Phone', and look for 'Status'. There, the IMEI information will be listed.

Next, to check whether the mobile phone is from within the country or from abroad, you can open the Settings application on the phone, then go to the Settings menu and find the "About Phone" or "About Device" option. Please note that the name of this menu may vary depending on the brand and model of the phone.

In the "About Phone" menu, check the model number. The model code for iPhones distributed in Indonesia usually ends with PA/A, ID/A, FE/A, or SA/A. For example, codes like MF234PA/A or MF353PA/A indicate that the iPhone is an official distribution in Indonesia.

If it's not that model number, then the iPhone comes from abroad, so don't forget to check the website. https://www.beacukai.go.id/cek-imei.html to find out whether the IMEI has already been registered with Customs or not.

We also remind you not to be tempted by IMEI booster services. Because it is clearly not from Customs and does not go through official Customs procedures.

For sure, my friend!
