Foreigner from Ukraine Wins Lawsuit all the Way to the MA, Here's the Explanation from Denpasar District Court

This time, the complaint comes from a Foreign National (FN) from Ukraine, Sergio (40), who feels confused and aggrieved because the Denpasar District Court (PN) has not yet carried out the execution of the legally binding court decision (inkracht van gewijsde).

Sergio, who is fighting for the right to rent a store in the Ubud area, has gone through a long legal process up to the Supreme Court (SC). Along with his lawyer, Erwin Siregar, he is demanding clarity on the execution that has not yet been carried out.

"Our client incurred losses of around 2 billion Rupiah. We have won the case at the District Court, High Court, and Supreme Court levels. Even the lawsuit against execution has been won by us. However, as of now, this ruling has not been executed by the PN Denpasar," said Erwin Siregar to the press on Tuesday, June 17, 2025.

Responding to the controversy, the Spokesperson for the Denpasar District Court, Gede Putra Astawa, provided an official explanation. He emphasized that the Denpasar District Court did not intend to complicate the implementation of the ruling.

There are several considerations, especially the principle of judicial caution.

"The court adheres to the principle of caution in implementing every legal decision, especially during the execution phase. This is aimed at preventing any legal or administrative violations during the process," he explained.

Currently, PN Denpasar is in the process of replacing officials, including the Chief Judge and Clerk.

The former registrar is scheduled to hand over the position on June 22, 2025, as they will be transferred to PN Tangerang.
