While Sergeant Yun Heri Lubis was only charged under Article 303(1) of the Criminal Code in conjunction with Article 55 on gambling.
Monitoring at the Military Court, the defendant arrived escorted by TNI members and entered the courtroom. The trial was presided over by Colonel CHK (K) Fredy Ferdian Isnartanto, the chairman of the military court panel.
"Today is the reading of the charges, are you ready, sir? Prosecutor ready?" asked the judge.
"Yes," the defendant replied.
Before reading the indictment, the Military Prosecutor requested the court's permission to read only the key points of the indictment and additional witness statements.
"This is a 140-page document. We did not read the testimonies of witnesses 1 to 32, but we read the additional and other witnesses. May I have your permission, Your Honor," said the military prosecutor.
Kopda Bazarsah's Income
In the previous session, it was revealed that Kopda Bazarsah's income came from managing a cockfighting business.
So, the suspect in the shooting that killed three police officers from Negara Batin Lampung could gain an average profit of between Rp 12 million to Rp 30 million per month.
That was revealed during the trial held at the Palembang Military Court I-04, with the agenda of examining the defendant, Monday (14/7/2025).
Initially, the judge asked the defendant about income from gambling business.
"How much can you get from the gambling business," asked the Chairman of the Court, Colonel CHK (K) Fredy Ferdian Isnartanto.
Bazarsah admitted that he set his income from the commission money at 10 percent of one game.
In a day, rooster fights can be held up to 10 to 15 times.
"Calculated to be around Rp 12 million per month. If there is an event, it can reach Rp 30 million, usually I take 10 percent from the player," said Bazarsah.
Hearing this statement, the Chairman of the Court was shocked and compared it with the salary of a general.
"His money is big. Even the general's salary is inferior," said the chairman of the court.
He opened a gambling business by inviting Peltu Lubis in 2023. Previously, he had also opened a gambling arena, but the activity was not long before it was opened. Bazarsah was arrested by Denpom because of involvement in illegal possession of firearms, as an intermediary.
"Once I was also detained for the case of illegal possession of firearms, I acted as an intermediary for sales. The person who bought the weapons was a friend, I just acted as an intermediary and was sentenced to 5 months and 28 days," he said.
Bazarsah continued, admitting that he had established a permanent location for cockfighting gambling, so that the gambling he managed in the Umbul Naga area could generate money regularly.
The gambling arena he manages together with Lubis is open twice a week, every Monday and Thursday, with a monthly large event once or twice.
"For the sake of noble profit," he said.
Bazarsah admitted that the money from his gambling earnings was used as additional personal needs, some of it spent in the gambling arena.
"Salary is still around Rp 5-6 million, sir. If there is gambling money, I use it there," he said.
Claim Burned
Bazarsah was questioned by the Military Court of Palembang I-04 and the military prosecutor regarding his actions that led to three officers from Negara Batin Police Station, Lampung being shot.
The shooting incident occurred when the police raided a cockfighting arena owned by Kopda Bazarsah.
In his statement during the trial, Kopda Bazarsah claimed to have felt threatened and was shot during the raid.
The President of the Court, Colonel CHK (K) Fredy Ferdian Isnartanto said that what the defendant feels is wrong and cannot be proven.
Because at the time of the incident, none of the bullets fell near the defendant.
"They did not shoot in a threatening manner, although the person shot upwards. I feel that it is only the brother's feeling. In fact, there was nothing, the police know that they faced the public. It is impossible for them to shoot towards the brother," said the Chief Judge to the defendant.
However, the defendant still admitted that he felt threatened because there were many shots directed at him.
Judge once again emphasized to the defendant how he could feel there was a threat. But the defendant was unable to answer.
"Maybe I should ask how it feels to be threatened, whether there were any bullets fired at the relatives. There were none (shooting). If there were, the bullet could have gone straight through 300-400 meters, as there are many people there. It's impossible to shoot at the relatives, as the police there are performing their duties," said the judge.
"There is no community that is hit, only bullets from relatives that are hit," he continued.
The military judge reminded the defendant to give truthful testimony and convey it correctly.
"Because I saw this defendant speaking as if defending himself," said the Prosecutor.
